Regolamento di funzionamento

Art. 1 – Costituzione, denominazione e sede

1. È costituito il Centro di ricerca Interdipartimentale di Studi e Documentazione sulla Cina e sull’Asia orientale, di seguito denominato “Centro” o “CSDC”.

2. Il Centro è promosso dal Dipartimento di Scienze Politiche, dal Dipartimento di Lingue, Letterature e Culture straniere, dal Dipartimento di Architettura dell’Università degli Studi Roma Tre.

3. Il Centro ha sede amministrativa presso il Dipartimento cui afferisce il Direttore.

4. Il Centro ha autonomia regolamentare e gestionale ai sensi dell’articolo 6 del Regolamento di Ateneo per l’amministrazione, la finanza e la contabilità.

5. Il Centro si configura come un centro secondario di gestione, con autonomia regolamentare, organizzativa e gestionale; non è dotato di autonomia amministrativa e contrattuale.

Art. 2 – Scopi e attività

1. Il Centro ha lo scopo di promuovere e realizzare studi avanzati a carattere interdisciplinare sulla Cina e degli altri Paesi del polo confuciano.

2. Per il raggiungimento dei suoi scopi il Centro può, anche in collaborazione o per conto di altri soggetti:

  1. sviluppare e coordinare programmi di ricerca;
  2. promuovere conferenze, seminari, convegni;
  3. costituire una rete informativa tra tutti gli studiosi;
  4. realizzare pubblicazioni specializzate e contribuire a corsi di alta formazione;
  5. favorire rapporti e promuovere collaborazioni con istituzioni universitarie e soggetti culturali e scientifici nazionali, comunitari e internazionali sia pubblici che privati.

Art. 3 – Composizione e afferenze

1. Sono membri ordinari del Centro i docenti proponenti ai sensi del successivo articolo 14 comma 1, nonché i docenti di ruolo dei Dipartimenti afferenti la cui domanda di adesione, presentata per iscritto al Direttore, dopo averne dato formale notizia al Dipartimento di appartenenza, sia stata approvata dal Consiglio.

2. Il Consiglio può deliberare, su proposta scritta di uno o più membri, l’ammissione, senza acquisizione del titolo per partecipare agli organi decisionali, di studiosi italiani e stranieri con la qualifica di membri aggregati, previa presentazione di domanda scritta al Direttore.

3. È possibile l’afferenza a titolo personale di docenti di altri Dipartimenti, previa domanda presentata per iscritto al Direttore, dopo averne dato formale notizia al Dipartimento di appartenenza e approvazione del Consiglio.

Art. 4 – Organi

1. Sono organi del Centro:

  1. il Direttore;
  2. l’eventuale Direttore vicario;
  3. la Giunta e il Consiglio;
  4. il Presidente onorario.

Art. 5 – Consiglio

1. Il Consiglio è formato dai membri ordinari del Centro di cui all’art. 3.

2. Il Consiglio è convocato e presieduto dal Direttore; per le modalità di svolgimento delle riunioni si applica l’art. 44 dello Statuto di Ateneo.

3. Il Consiglio:

  1. definisce il programma annuale delle attività del Centro;
  2. approva e verifica il piano preventivo dell’utilizzazione delle risorse,
  3. approva le proposte di stipula di contratti, convenzioni e accordi di collaborazione scientifica relativi alle attività del Centro, dei quali propone la stipula al Dipartimento sede amministrativa;
  4. approva la relazione annuale sulle attività svolte, di cui all’art. 20, comma 5 del Regolamento generale di Ateneo, da trasmettere ai Dipartimenti aderenti e al Senato Accademico;
  5. elegge il Direttore e la Giunta. Per tale adempimento il Consiglio è convocato e presieduto dal decano fra i suoi membri. La votazione deve svolgersi tra sessanta e quindici giorni prima del termine del mandato del Direttore in carica. Per la prima elezione del Direttore, il Consiglio è convocato dal Decano dei propri componenti entro 30 giorni dalla data di attivazione del Centro. Nei casi di termine anticipato del mandato del Direttore, il Decano convoca il Consiglio a riunirsi entro 30 giorni dalla cessazione del mandato.

4. Alle riunioni del Consiglio partecipa con voto consultivo il Segretario Amministrativo del Dipartimento ove ha sede il Centro, che svolge le funzioni di segretario verbalizzante, come da art. 10, comma 2.

5. Alle riunioni del Consiglio possono partecipare, senza diritto di voto, i membri aggregati, di cui all’art. 3, commi 2 e 3.

Art 6 – Giunta

1. La Giunta coadiuva il Direttore nello svolgimento delle sue funzioni per l’esecuzione delle attività scientifiche del Centro, nella gestione del Centro e nella realizzazione del programma annuale di attività.

2. La Giunta è composta un componente per ciascuno dei Dipartimenti interessati, oltre il Direttore.

3. La Giunta è presieduta dal Direttore, che la convoca, e, in caso di assenza, dal suo Vicario.

4. La Giunta è eletta dal Consiglio fra i suoi componenti. Ciascun elettore può esprimere un solo voto. Risultano eletti coloro che ottengono il maggior numero di voti.

5. I componenti della Giunta durano in carica tre anni accademici (e comunque decadono con la conclusione del mandato del Direttore anche se anticipata) e sono rieleggibili per non più di una volta consecutivamente.

Art. 7 – Direttore e Direttore vicario

1. Il Direttore è eletto dal Consiglio tra i suoi membri ordinari e nominato con decreto del Rettore.

2. Il mandato del Direttore ha durata di tre anni accademici ed è rinnovabile per non più di una volta consecutivamente. In caso di durata del mandato inferiore a tre anni accademici, ai fini del rinnovo del mandato si applicano le norme di cui all’art. 41, comma 8 dello statuto di Ateneo.

3. Il Direttore:

  1. presiede il Consiglio, cui presenta le proposte di deliberazione e ne cura l’esecuzione delle deliberazioni;
  2. promuove lo svolgimento delle attività del Centro, vigilando sull’osservanza delle leggi, dello Statuto e dei regolamenti di Ateneo;
  3. esercita tutte le altre funzioni che gli sono attribuite dalle leggi, dallo Statuto e dai regolamenti di Ateneo.

4. Il Direttore è il consegnatario dei beni in uso al Centro, ne coordina le attività e i servizi, ordina quanto occorre al suo funzionamento e sovrintende alla sua gestione.

5. Il Direttore può delegare parte delle sue competenze a un Direttore vicario, scelto fra i componenti della Giunta.

6. Il Direttore vicario rimane in carica fino al termine del mandato del Direttore e può essere nuovamente nominato nella sua funzione. Svolge funzione sostitutiva in caso di assenza o impedimento temporaneo.

Art. 8 – Presidente onorario

1. Il Consiglio può designare, con una maggioranza di almeno due terzi dei componenti del Consiglio, il Presidente onorario tra gli aderenti al Centro.

2. Il Presidente onorario è nominato con decreto del Rettore, dura in carica tre anni accademici e può ricoprire la carica per non più di una volta consecutivamente. In caso di durata del mandato inferiore a tre anni accademici, ai fini del rinnovo del mandato si applicano le norme di cui all’art. 41, comma 8 dello statuto di Ateneo.

3. Il Presidente onorario:

  1. collabora con il Direttore nella predisposizione della programmazione annuale delle attività del Centro;
  2. partecipa, su invito del Direttore e con funzione propositiva e consultiva, alle riunioni del Consiglio;
  3. promuove, di intesa con il Direttore, l’instaurazione di rapporti di collaborazione scientifica;
  4. può esercitare, su delega del Direttore, la rappresentanza del Centro nei convegni e in altre analoghe iniziative scientifiche. 3. Al Presidente onorario non sono attribuiti poteri di rappresentanza ufficiale del Centro, né deleghe operative.

Art. 9 – Risorse

1. Le risorse del Centro, in relazione alle finalità da esso perseguite, sono rappresentate:

  1. da eventuali contributi messi a disposizione da ciascuno dei Dipartimenti interessati;
  2. contributi del MIUR, del CNR, di Organismi internazionali, dell’Unione Europea, dello Stato italiano, di Enti Locali, di soggetti pubblici e privati;
  3. eventuali proventi per attività conto terzi;
  4. fondi di ricerca pubblici e privati assegnati a componenti del Centro per lo svolgimento di ricerche presso il Centro;
  5. contributi annuali dai fondi individuali dei membri ordinari;
  6. corrispettivi derivanti dalla vendita di pubblicazioni del Centro e dalle attività realizzate anche nella didattica e nella organizzazione e promozione di attività culturali con le risorse del Centro, compatibilmente e nei limiti dei Regolamenti di Ateneo in materia di didattica e di gestione amministrativa, finanziaria e contabile;
  7. contributi di iscrizione a iniziative scientifiche;
  8. atti di liberalità.

Art. 10 – Gestione

1. Le attività amministrative e contabili sono assicurate dal Dipartimento sede amministrativa del Centro, conformemente al Regolamento di Ateneo per l’amministrazione, la finanza e la contabilità.

2. Il Segretario Amministrativo del Dipartimento ove ha sede il Centro partecipa, senza diritto di voto, alle sedute del Consiglio in cui si approvano il piano preventivo dell’utilizzo delle risorse e può, a sua discrezione, assistere a ogni altra riunione del Consiglio. Per la gestione del Centro si applicano le norme del regolamento contabile di Ateneo.

3. Il Direttore del Dipartimento sede amministrativa del Centro stipula le convenzioni e i contratti relativi alle attività del Centro, proposti con delibera del Consiglio del Centro e approvati con delibera del Consiglio del Dipartimento sede amministrativa del Centro.

4. Al Direttore del Dipartimento sede amministrativa del Centro sono attribuite le funzioni, le relative responsabilità e i poteri, anche di spesa, connessi all’applicazione delle norme sulla sicurezza e sulla salute dei lavoratori.

Art. 11 – Durata, recesso e disattivazione

1. La durata del Centro è stabilita in tre anni accademici.

2. A seguito della trasmissione della terza relazione annuale sulle attività svolte, di cui all’art. 5, il Consiglio di Amministrazione, sulla base della valutazione delle attività svolte dal Centro effettuata dal Nucleo di Valutazione e acquisito il parere del Senato Accademico, delibera in merito al proseguimento dell’attività del Centro, se vi sia una richiesta in tal senso dei Dipartimenti aderenti, o alla sua eventuale disattivazione.

3. Il recesso dei membri avviene mediante comunicazione scritta al Direttore, il quale ne dà notizia alla Giunta e al Consiglio.

4. Un Dipartimento aderente può recedere dal Centro, con propria delibera consiliare, di cui viene data comunicazione al Direttore del Centro e agli organi centrali dell’Ateneo.

5. Il Dipartimento recedente è tenuto a concludere, per il tramite del proprio personale afferente al Centro, le eventuali attività in corso al momento del recesso.

6. Il Consiglio del Centro può deliberare in merito alla disattivazione della struttura, dandone comunicazione ai Dipartimenti aderenti e agli organi centrali dell’Ateneo. Nella delibera il Consiglio del Centro stabilisce la ripartizione tra i Dipartimenti aderenti delle eventuali risorse finanziarie assegnate al Centro.

7. Il Centro è formalmente disattivato con decreto del Rettore, previa delibera del Consiglio di Amministrazione.

8. In caso di scioglimento disattivazione del Centro, le risorse disponibili verranno divise in parti uguali fra i Dipartimenti che lo compongono.

Art. 12 – Modifiche del Regolamento

1. Le modifiche al presente regolamento possono essere proposte con delibera del Consiglio del Centro a maggioranza dei voti degli aventi diritto e sono sottoposte all’approvazione degli organi centrali dell’Ateneo, a seguito della quale sono emanate con decreto del Rettore.

Art. 13 – Norme transitorie

1. Fanno parte del Centro quali membri ordinari, nella sua prima composizione, i docenti dei Dipartimenti promotori che siano firmatari della proposta di costituzione come da allegato 1 al presente Regolamento.

2. Entro trenta giorni dall’attivazione del Centro, il decano fra i membri ordinari convoca il Consiglio per le elezioni del Direttore e della Giunta e per l’approvazione del Regolamento definitivo.

Article 1 – Constitution, name and seat

1. The Interdepartmental Research Centre for Studies and Documentation on China and East Asia (it. “Centro di ricerca Interdipartimentale di Studi e Documentazione sulla Cina e sull’Asia orientale”), hereinafter referred to as “Centre” or “CSDC”, is established.

2. The Centre is promoted by the Department of Political Sciences, the Department of Foreign Languages, Literatures and Cultures and the Department of Architecture of the University of Roma Tre.
3. The Centre has its administrative seat in the Department to which the Director belongs.

4. The Centre has regulatory and management autonomy in accordance with article 6 of the University Regulation for Administration, Finance and Accounting.
5. The Centre is a secondary management centre, with regulatory, organizational and management autonomy; it does not have administrative and contractual autonomy.

Article 2 – Aims and activities

1. The Centre aims to promote and carry out advanced interdisciplinary studies on China and other countries of the Confucian pole.
2. In order to achieve its aims, the Centre may, also in collaboration with or on behalf of other subjects

(a) develop and coordinate research programmes;

(b) promote conferences, seminars, symposia;

(c) set up an information network among all scholars

(d) produce specialised publications and contribute to advanced training courses;

(e) to foster relations and promote collaboration with university institutions and national, Community and international cultural and scientific bodies, both public and private.

Article 3 – Composition and afference

1. The ordinary members of the Center are the professors proposing their candidacy according to the following article 14, paragraph 1, as well as the tenured professors of the afferent Departments whose application for membership, submitted in writing to the Director, after having formally informed the Department to which they belong, has been approved by the Council.

2. The Council can deliberate, on the written proposal of one or more members, the admission, without the acquisition of the title to participate in the decisional organs, of Italian and foreign scholars with the qualification of aggregate members, upon presentation of a written application to the Director.

3. It is possible for professors of other Departments to become members in their personal capacity, upon written application to the Director, after formal notification to the Department to which they belong and approval by the Council.

Article 4 – Organization

1. The bodies of the Center are
(a) the Director;
(b) the eventual Deputy Director;
(c) the Council and the Board;
(d) the Honorary President.

Article 5 – Council

1. The Council is made up of the ordinary members of the Center referred to in Article 3.

2. The Council is convened and chaired by the Director; for the modalities of the meetings, art. 44 of the University Statute applies.

3. The Council:
(a) defines the annual program of activities of the Center;
(b) approves and verifies the preliminary plan for the use of resources,
(c) approves the proposals for the stipulation of contracts, conventions and agreements of scientific collaboration related to the activities of the Center, of which it proposes the stipulation to the Department administrative headquarters;
(d) approves the annual report on the activities carried out, as per art. 20, paragraph 5 of the General Regulations of the University, to be transmitted to the member Departments and to the Academic Senate;
(e) elects the Director and the Council. For this purpose the Council is convened and chaired by the Dean among its members. The vote must take place between sixty and fifteen days before the end of the term of office of the Director in office. For the first election of the Director, the Council is convened by the Dean of its members within 30 days from the date of activation of the Center. In cases of early termination of the Director’s mandate, the Dean shall convene the Council to meet within 30 days from the termination of the mandate.

4. The Administrative Secretary of the Department where the Center is located participates in the meetings of the Council with an advisory vote and acts as the secretary taking the minutes, as per art. 10, paragraph 2.

5. Aggregate members, as per art. 3, paragraphs 2 and 3, can participate in the meetings of the Council without the right to vote.

Article 6 – Board

  1. The Board assists the Director in carrying out his functions for the execution of the scientific activities of the Center, in the management of the Center and in the realization of the annual program of activities.
  2. The Board is composed of one member for each of the Departments involved, besides the Director.
  3. The Board is chaired by the Director, who convenes it, and, in case of absence, by his Vicar.
  4. The Board is elected by the Council from among its members. Each voter may express only one vote. Those who obtain the highest number of votes are elected.
  5. The members of the Board shall remain in office for three academic years (and in any case shall expire with the end of the Director’s term, even if anticipated) and may be re-elected for no more than one consecutive term.

Article 7 – Director and Deputy Director

  1. The Director is elected by the Council from among its ordinary members and appointed by decree of the Rector.
  2. The Director’s term of office lasts for three academic years and may be renewed for no more than one consecutive term. In the case of a term of office of less than three academic years, for the purposes of the renewal of the term of office the norms of Article 41, paragraph 8 of the University Statute are applied.
  3. The Director:
    (a) presides over the Council, to which he/she submits proposals for resolutions and takes care of the execution of the resolutions;
    (b) promotes the activities of the Center, supervising the observance of the laws, of the Statute and of the University regulations;
    (c) exercises all the other functions attributed to it by the laws, the Statute and the University regulations.
  4. The Director is the consignee of the goods in use at the Center, coordinates its activities and services, orders whatever is necessary for its functioning and supervises its management.
  5. The Director may delegate part of his/her competences to a vicarious Director, chosen among the members of the Council.
  6. The vicarious Director shall remain in office until the end of the Director’s term of office and may be re-appointed in his function. He/she carries out a substitutive function in case of absence or temporary impediment.

Article 8 – Honorary President

  1. The Council can designate, with a majority of at least two thirds of the members of the Council, the Honorary President among the members of the Center.
  2. The Honorary President is appointed by decree of the Rector, remains in office for three academic years and can hold office for no more than one consecutive time. In the case of a term of office shorter than three academic years, for the purposes of the renewal of the term of office, the norms of art. 41, paragraph 8 of the University Statute shall be applied.
  3. The Honorary President:
    (a) collaborates with the Director in the preparation of the annual planning of the activities of the Center;
    (b) participates, upon invitation of the Director and with a proposing and consulting function, in the meetings of the Board;
    (c) promotes, in agreement with the Director, the establishment of scientific collaboration relationships;
    (d) by delegation of the Director, may represent the Center in conventions and other similar scientific initiatives. 3. The Honorary President has no powers of official representation of the Center, nor operational delegations.
    Art. 9 – Resources
  4. The resources of the Center, in relation to the aims it pursues, are represented by
    (a) any contributions made available by each of the Departments concerned;
    (b) contributions from MIUR, CNR, international organizations, the European Union, the Italian State, local authorities, public and private entities;
    (c) eventual proceeds for activities on behalf of third parties;
    (d) public and private research funds assigned to members of the Center for carrying out research at the Center;
    (e) annual contributions from the individual funds of ordinary members;
    (f) fees deriving from the sale of the Center’s publications and from the activities carried out, also in didactics and in the organization and promotion of cultural activities with the Center’s resources, compatibly with and within the limits of the University Regulations regarding didactics and administrative, financial and accounting management;
    (g) contributions to scientific initiatives;
    (h) donations.

Article 10 – Management

  1. Administrative and accounting activities are carried out by the Department which is the administrative headquarters of the Center, in accordance with the University Regulations for Administration, Finance and Accounting.
  2. The Administrative Secretary of the Department where the Center is located participates, without the right to vote, in the meetings of the Board in which the budget for the use of resources is approved and may, at his discretion, attend any other meeting of the Board. For the management of the Center the rules of the University accounting regulations are applied.
  3. The Director of the Department administrative seat of the Center stipulates the conventions and contracts relating to the activities of the Center, proposed by resolution of the Council of the Center and approved by resolution of the Council of the Department administrative seat of the Center.
  4. The Director of the Department of the administrative seat of the Center is attributed the functions, the relative responsibilities and the powers, also of expenditure, connected to the application of the norms on the safety and health of the workers.

Article 11 – Duration, withdrawal and deactivation

  1. The duration of the Center is established in three academic years.
  2. Following the transmission of the third annual report on the activities carried out, as per art. 5, the Board of Directors, on the basis of the evaluation of the activities carried out by the Center carried out by the Evaluation Committee and having acquired the opinion of the Academic Senate, decides on the continuation of the Center’s activity, if there is a request to that effect from the adhering Departments, or on its possible deactivation.
  3. The withdrawal of the members takes place by means of a written communication to the Director, who notifies the Board and the Council.
  4. A member Department may withdraw from the Center, with its own deliberation, of which the Director of the Center and the central organs of the University are informed.
  5. The withdrawing Department is required to conclude, through its own personnel belonging to the Center, any activities in progress at the time of withdrawal.
  6. The Council of the Center can deliberate on the deactivation of the structure, informing the member Departments and the central bodies of the University. In the resolution the Council of the Center establishes the distribution among the adhering Departments of any financial resources assigned to the Center.
  7. The Center is formally deactivated by decree of the Rector, after deliberation of the Board of Directors.
  8. In case of dissolution or deactivation of the Center, the available resources will be divided in equal parts among the Departments that compose it.

Article 12 – Amendments to the Regulations

  1. Modifications to these Regulations may be proposed by resolution of the Council of the Center by majority vote of those entitled to vote and are submitted for approval to the central bodies of the University, following which they are issued by decree of the Rector.

Article 13 – Transitory norms

  1. The teachers of the promoting Departments who are signatories of the proposal of constitution, as per attachment 1 to these Regulations, are part of the Center as ordinary members, in its first composition.
  2. Within thirty days from the activation of the Center, the Dean among the ordinary members shall convene the Council for the elections of the Director and of the Board and for the approval of the definitive Regulations.
